Terms of Service

1. Acceptance of Terms
Poly is operated by Colorful Aura Inc., a New York corporation ("Poly," "we," "us"). These Terms of Service ("Terms") govern your use of the Poly web application at usepoly.co (the "Service").
You accept these Terms by checking the acceptance box when you create an account, or by using the Service. You must be able to form a binding contract to accept — see Section 2 on eligibility. If you're accepting on behalf of an organization, you're confirming you have authority to bind that organization.
We may update these Terms from time to time. We'll post the updated version with a new effective date and version number, and for material changes we'll give you notice (email and/or in-app). Continuing to use the Service after a material change takes effect means you accept the updated Terms. We keep prior versions on file so you can see what changed.
2. Eligibility
You must be at least 18 years old to use Poly. The Service gives AI agents the ability to run real code and interact with real developer infrastructure, and the AI processing behind it is subject to the usage terms of our AI providers (Anthropic and OpenAI) — so we keep Poly adult-only. If we learn an account belongs to someone under 18, we'll close it.
3. Your Account
You're responsible for:
- Keeping your login credentials (and any 2FA recovery codes) secure and confidential.
- The truthfulness of the information you give us when you sign up.
- All activity that happens under your account, including AI turns you run and the usage they consume.
- Any GitHub token you supply to the Service, and everything that token is used to do through Poly.
Accounts are for one person each — don't share logins. Let us know right away if you think your account or a token you've connected has been compromised.
4. Acceptable Use
You agree not to use Poly to:
- Upload, generate, or distribute illegal content, or content you don't have the rights to.
- Use our compute, sandboxes, or AI turns to attack third-party systems, mine cryptocurrency, send spam, scrape other services abusively, or otherwise exceed what the Service is built to do.
- Attempt to circumvent sandbox isolation or network egress restrictions on AI-agent execution.
- Try to extract, exfiltrate, or gain unauthorized access to other members' tokens or credentials, or to the platform credentials Poly uses to provide AI processing.
- Prompt-inject, manipulate, or interfere with another user's AI agent or room without their consent.
- Publish deceptive or harmful content through public share links — including phishing pages, malware, pages that impersonate another person, product, or service, or pages designed to trick visitors into revealing credentials or payment details.
- Abuse free-beta resources — for example, creating excessive accounts or rooms to get around usage limits, or intentionally overloading shared infrastructure.
- Exceed rate limits, usage limits, or project/room limits we put in place.
We may suspend or limit access to protect the Service or other users if we reasonably believe you've violated this section.
5. Your Content and Intellectual Property
Ownership. You retain ownership of the code, files, prompts, and other content you upload to Poly ("Your Content"). We don't claim ownership of it.
License to us. By uploading Your Content, you grant us a limited license to host, store, back up, display it to your room's members, and transmit it to our AI providers (currently Anthropic and OpenAI, depending on the model a turn uses) to run the turns you and your room request, solely to operate the Service for you.
Your warranty. You confirm you have the rights needed to upload what you upload — including code owned by your employer or another third party. Don't upload content you don't have permission to share, even within a private room.
How rooms work. A room is a shared space. When you join or create one:
- All content in the room — prompts, AI replies, code, chat, threads, uploaded files, polls, and approval history — is visible to every member of that room.
- The room owner can delete the entire project, including contributions from other members. That deletion is permanent.
- Other members can steer, stop, or revert AI agent work in the room. That's how the product is meant to work, not a violation of your rights.
- You're responsible for who you invite into your rooms.
Public share links. A room's owner can publish a built, static copy of a project to a public URL. Published content is visible to anyone with the link, without a Poly account. Publishing is announced in the room; the owner is responsible for what their rooms publish, and the license you grant us above extends to serving published content publicly while it remains published. We may unpublish or disable a public link at any time, including for the reasons in Section 4. To report abusive published content, email support@usepoly.co.
AI output. The legal status of AI-generated code and content is currently unsettled. We don't claim ownership over AI output generated in your rooms, but we also can't guarantee you hold clean rights to it — that's between you, the applicable law, and the terms of the AI provider that generated it (Anthropic or OpenAI).
6. AI Processing and Usage Limits (Anthropic and OpenAI)
Poly provides the AI. Turns run against our AI providers' APIs using Poly's own provider accounts — which provider handles a turn depends on the model chosen for it: Claude models run on Anthropic's API, and GPT models run on OpenAI's API. Image generation always uses an OpenAI model, even when requested during a turn running on a Claude model. You don't need an Anthropic or OpenAI account or API key, and you never supply one to us. (Accounts created before August 3, 2026 may have stored an Anthropic API key under the old bring-your-own-key model; those keys have been deleted from our systems and are no longer used.)
This means:
- Usage is metered in credits. Running the agent consumes credits from your account balance (see Section 13), whichever provider handles the turn. Every account starts with free credits; when your balance runs out, turns pause until you top up or subscribe — everything else in the app keeps working. We may apply per-turn or daily ceilings, or throttle usage, to protect the Service.
- To run a turn, we transmit your prompts, the workspace contents the agent needs to read, and relevant conversation history to the API of the provider whose model the turn uses (Anthropic or OpenAI), and we record the cost of each turn against your account (see the Privacy Policy).
- The providers' rules still apply. Because your turns run on our provider accounts, you agree to comply with Anthropic's Usage Policy and OpenAI's Usage Policies as they apply to content you generate through Poly. Usage that puts our Anthropic or OpenAI account at risk is a violation of these Terms.
We're not Anthropic or OpenAI and can't speak for how they handle data sent to them — see each provider's own policies for that.
7. AI Output Is Not Reviewed by Us
The AI agents in Poly write and execute code, including running commands in sandboxed containers and pushing commits to your connected GitHub repositories (with tokens you supply; commits are attributed to the user who triggered the action). This output:
- May be inaccurate, insecure, or destructive to your own workspace or repository.
- Is not professional, legal, security, or other expert advice.
- Should be reviewed by you before you rely on it, merge it, deploy it, or otherwise put it into use.
You're solely responsible for what you do with AI output generated in your rooms, and for making sure your use of it complies with the usage policies of the provider that generated it (Anthropic or OpenAI) and applicable law.
8. Beta Service, Disclaimers, and Limitation of Liability
This is a beta service. Poly is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't promise any specific uptime or SLA. Features may change, break, or be discontinued at any time. Despite running daily backups, data loss is possible — don't treat Poly as your only copy of anything important.
Limitation of liability. To the fullest extent permitted by law, Colorful Aura Inc. and its team won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is capped at the greater of (a) $100, or (b) the total amount you've paid us for the Service in the 12 months before the claim.
Indemnification. You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
Maintenance. The Service may be temporarily unavailable during deploys, maintenance, or incidents.
9. Termination
By you: Stop using the Service anytime, or request account/data deletion by contacting us at support@usepoly.co.
By us: We may suspend or terminate your account for violating these Terms, abusing the Service, or causing harm to the Service or other users, and may terminate accounts that have been inactive for an extended period. Where practical, we'll give you reasonable notice first.
Effect of termination: Once your account is terminated, your access ends and your data is handled per our Privacy Policy's retention and deletion practices, including backup rotation timelines.
10. Copyright Complaints (DMCA)
If you believe content on Poly infringes your copyright, send a notice to our designated agent:

Include the information required under 17 U.S.C. § 512(c)(3). We'll respond in accordance with the DMCA.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
Agreement to arbitrate. You and Colorful Aura Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and will take place (or be conducted by phone/video/written submission, at the arbitrator's discretion) in New York, New York.
Class action waiver. You and Colorful Aura Inc. agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate claims of more than one person.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@usepoly.co within 30 days of first accepting these Terms, stating your name and that you wish to opt out of arbitration. If you opt out, disputes will instead be resolved in the state or federal courts located in Kings County, New York, and you consent to personal jurisdiction there.
Injunctive relief. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent unauthorized use or abuse of the Service, or infringement of intellectual property rights.
12. General
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
Entire agreement. These Terms (plus our Privacy Policy) are the whole agreement between you and us regarding the Service, superseding prior agreements on the subject.
Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
No waiver. Our failure to enforce a provision isn't a waiver of our right to do so later.
13. Paid Plans, Credits, and Billing
Poly is free to start and offers paid subscriptions and credit top-ups. Current prices and what they include are on the pricing page; the summary below is how billing works, and nothing is ever charged without your explicit action in checkout.
Credits. Usage is denominated in credits (10 credits per US dollar of price). Credits are backed by underlying AI usage, and how far a credit stretches varies by how it was acquired — plan credits carry more usage than top-up credits. Credits are a prepaid usage allowance, not money: they have no cash value, are non-transferable and non-redeemable, and are for use inside Poly only. Free and promotional credits we grant can be adjusted or expired by us.
Subscriptions. Plans are monthly, auto-renewing subscriptions. Each billing period grants the plan's credit allowance; plan credits reset at each renewal and unused plan credits do not roll over. You can cancel anytime from Billing — cancellation takes effect at the end of the paid period, and you keep the remainder of that period.
Top-up packs. One-time purchases of additional credits. Top-up credits never expire and are spent after plan credits.
Failed turns. If a turn fails because of a Poly-side error, the credits it consumed are returned automatically.
Payment processing. Payments are handled by Stripe — card details go directly to Stripe and never touch our servers. Prices may be subject to sales tax or VAT depending on where you are, calculated at checkout. Except where required by law, payments are non-refundable once a billing period has started or a pack has been delivered; if you think you've been charged in error, contact us and we'll make it right.
Price changes. If we change prices or what a plan includes, we'll announce it before it takes effect and it will never apply retroactively to a period you've already paid for.
Account deletion. Deleting your account cancels any active subscription immediately and forfeits any remaining credits.
